Madison County, Illinois official faces cocaine, other chargesEDWARDSVILLE, Illinois -- Madison County, Illinois chief probation officer was placed on administrative leave Monday and also was charged in St. Clair County, Illinois with cocaine possession, resisting arrest and attempting to elude Illinois police officers in connection with a weekend incident. Herb Clay, who also is an alderman on the Edwardsville City Council, was accused of leading Illinois police officers on a high-speed chase Saturday afternoon through East St. Louis, Illinois and Fairmont Park. Police said they found Clay to have cocaine in his possession. He was held at the East St. Louis, Illinois Jail until he posted bond and was released Monday morning.
East St. Louis, Illinois Police Chief Ronald Matthews said plainclothes detectives with the city’s special Strategic Anti-Felony Enforcement Team observed Clay’s sport utility vehicle roll through a stop sign at the intersection of 15th and Lynch streets about 2:30 p.m. Saturday, in an area known for narcotics and other illegal activities. Officers then pulled alongside his vehicle, and Clay apparently shouted "I’m one of you guys" before speeding off in the 1999 black Ford Explorer he was driving and beginning the high-speed chase through the city and into Fairmont Park, Matthews said.
During the pursuit, Illinois officers witnessed Clay throw an item from his moving vehicle, but a later search failed to turn up any evidence. Matthews said the officers finally stopped Clay near Illinois Route 203 and Collinsville Road and ordered him out of the car.
Matthews said that after stepping onto the road, Clay refused to cooperate with the Illinois officers, and a struggle ensued before he was immobilized with a Taser gun.
Once back at the East St. Louis, Illinois Police Department and out of handcuffs, Clay allegedly removed a white and powdery substance from his pocket and attempted to consume it before police searched him. Tests later proved the substance to be cocaine, along with some other powder residues in his vehicle, Matthews said.
"I always feel some stress and duress whenever incidents involving a law enforcement officer come up and we have to make an arrest, and my officers feel the same way," Matthews said.
Clay, 53, of the 600 block of East Vandalia Street in Edwardsville, incurred some minor injuries during the incident and was treated at St. Mary’s Hospital in East St. Louis, Illinois, where blood tests showed he was under the influence of both cocaine and alcohol, Matthews said. He was held over the weekend at the local Illinois police station on $10,000 bond.
Despite attempts Monday to contact him at his home and by telephone, Clay could not be reached for comment.
Darrell McGibany, Madison County director of probation and court services, said he was both shocked and saddened by the weekend’s events involving his friend and colleague of 30 years. Clay has been the county’s chief probation officer since 1998.
"What this shows is that drug problems cross all lines in our society. There are issues at every level, and law enforcement is no exception," McGibany said. "No level of this human life is immune."
Because of the circumstances surrounding the incident, Clay was placed on administrative leave from his county job on Monday, pending the outcome of his arrest and allegations, McGibany said.
Edwardsville, Illinois Mayor Gary Niebur said he also was shocked and surprised when he learned the details of the arrest.
"The situation as reported deeply saddens me. Mr. Clay has been a dedicated and effective member of our City Council," Niebur said. "We must now let the justice system take its course."
Niebur said it would be premature to comment about the possible effects of this incident on Clay’s position as a city official. Clay is now serving his second term as alderman for the city’s 5th Ward.
Clay is not the only public official in the family, as his wife, S. Wray Clay, serves as an Edwardsville School Board member and works for the United Way of Greater St. Louis. They have two children together and are widely known throughout the community for their public service and charity.
